Illinois Enacts AI Video Interview Law, EU Publishes Cybersecurity Action Plan
Illinois' new Public Act 103-0511 regulates AI in employment video interviews; concurrently, the European Union released a cybersecurity and AI action plan, highlighting diverse regulatory approaches.
Illinois Governor J.B. Pritzker recently signed Public Act 103-0511, establishing the Artificial Intelligence Video Interview Act. This legislation mandates that employers using AI to analyse video interviews must inform applicants. Employers must also provide an explanation of how the AI functions and which characteristics it uses to evaluate candidates. Furthermore, the act requires obtaining explicit consent from applicants for AI analysis. It also stipulates independent audits of these AI tools for unfairness or bias. Organisations must submit these audit results to the Department of Labour. The Act represents a first-in-the-nation attempt to regulate AI in employment processes, building upon previous legislative efforts concerning AI in hiring.
Simultaneously, the European Union has released a comprehensive Action Plan for Cybersecurity and Artificial Intelligence. This initiative aims to address the security implications arising from AI adoption across critical sectors. The plan focuses on four main pillars: securing AI development and deployment, leveraging AI for improved cybersecurity, enhancing human-centric AI and cybersecurity, and fostering international cooperation. Specific actions include developing standards for secure AI systems and establishing an EU Cybersecurity and AI Hub. The plan also proposes incorporating AI security into existing cybersecurity frameworks. It further suggests fostering research into AI-driven attack detection and response mechanisms. The EU's strategy integrates AI governance within its broader digital single market objectives.
These independent actions by Illinois and the European Union highlight a growing global trend toward AI regulation. Both frameworks aim to mitigate potential risks associated with AI deployment. Illinois focuses on employment practices, enhancing transparency and fairness. The EU's plan addresses the cybersecurity risks and opportunities presented by AI. These diverging approaches reflect varied jurisdictional priorities regarding AI governance.
