Illinois Enacts Comprehensive AI Governance Framework
Illinois implemented new legislation establishing an AI task force and regulatory framework, positioning the state at the forefront of AI governance.
Illinois has passed new legislation to regulate artificial intelligence, creating a comprehensive framework for its development and deployment. The Artificial Intelligence Video Interview Act, signed into law on 1 January 2020, addresses the use of AI in employment decisions. Building on this, Governor Pritzker signed House Bill 1075 into law on 26 July 2023. This bill creates the AI Video Interview Act, governing the use of AI in analysing job applicants. It also establishes the Artificial Intelligence Transparency and Accountability Act, which mandates disclosure when AI is used in hiring processes and requires audits for bias.
Further legislative action occurred with the passage of House Bill 3922 on 5 May 2024. This bill expands governmental oversight of AI, creating the Artificial Intelligence Advisory Committee. This committee, comprising various stakeholders, including academics, industry experts, and civil liberties advocates, will provide recommendations on AI policy to the General Assembly and the Governor. The legislation also establishes a statewide AI Bill of Rights, aiming to protect citizens from discriminatory or harmful applications of AI. It addresses the ethical implications of AI adoption, focusing on issues such as algorithmic bias and data privacy.
These measures position Illinois at the forefront of state-level AI regulation. The state’s approach combines transparency requirements, bias audits, and expert advisory bodies. This multi-faceted strategy seeks to balance technological innovation with public protection. House Bill 3922 passed both chambers of the Illinois General Assembly with bipartisan support. Representatives Foster and Meyers were key proponents of the legislation.
Illinois's framework includes provisions for ongoing review and adaptation as AI technologies evolve. The Artificial Intelligence Advisory Committee is tasked with monitoring advancements and proposing necessary updates to the regulatory landscape. Will Illinois' proactive stance encourage a national standard in AI governance?
